2. The petitioner has preferred this application for grant of regular bail in connection with Tillathu P.S. Case No. 10/2024 dated 12.01.2024 registered for the offence punishable u/s 302 read with 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused Bhura Paswan are alleged to have committed murder of the informant's husband by cutting his neck when her husband went to the boring of Raghupat Yadav for irrigating his field. Previously they also threatened to kill due to irrigation dispute.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.47715 of 2024(2) dt.30-07-2024 2/2 this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 13.01.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. As per the seizure list, the weapons used having blood stains and the clothes of the petitioner with blood stained were recovered from the house of the petitioner. The P.M. report shows that the cause of death is hemorrhage and shock due to above mentioned injuries. It is further submitted that there is sufficient material indicative of the petitioner's involvement in the alleged crime.

Considering the aforesaid facts and circumstances of the case as well as the heinous nature of allegation against the petitioner, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with Tillathu P.S. Case No. 10/2024 pending in the court of learned C.J.M., Rohtas at Sasaram.

7. This application stands rejected.
