The petitioner apprehends his arrest in Bhorey P.S. Case No. 8 of 2016 registered under Sections 302 and 201 of the Indian Penal Code.

The brother of the deceased made allegation that the petitioner, who is husband of the deceased, burnt his sister to death and he was always assaulting her after taking wine. Learned counsel for the petitioner submits that no sign of burn was found inside the house. It has come during the course of investigation that the petitioner always used to assault his wife after taking wine.

Considering the fact that the petitioner is husband of the deceased and even son of the petitioner stated that the

Patna High Court Cr.Misc. No.10845 of 2017 (2) dt.16-03-2017 2/2 petitioner used to assault the deceased with lathi, after taking wine, I am not inclined to enlarge the petitioner on anticipatory bail. It is accordingly, rejected.
