2. The petitioner has preferred this application for grant of anticipatory bail in connection with Lalganj P.S. Case no.77 of 2022 registered under sections 302 and 34 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, four named accused persons came armed with pistol. Hearing the sound of firing informant rushed towards the spot and saw co-accused Deomitra Shukla and co-accused Deepak Singh @ Halchal Singh armed with pistol running away. His son had sustained gunshot injury. On enquiry, his son disclosed that he had been shot upon by Ravi Kumar and Sangam Shukla. Thereafter the informant's son died

4. Learned counsel appearing for the petitioner submits that the informant claims himself to be eye witness of the occurrence and has named other accused persons as the assailant of his deceased son. Even, on enquiry, his son disclosed him ( informant ) that he had been shot upon by Ravi Kumar and Sangam Shukla. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Vaishali at Hajipur in Lalganj Police Station Case No. 77 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
