2. The petitioner seeks bail in connection with Chainpur P.S Case No. 306 of 2023 registered for the offences punishable under Sections 341, 323, 324 and 307/34 of the Indian Penal Code.
3. As per prosecution case, it is alleged that the petitioner along with other co-accused have assaulted the informant's husband by means of axe and iron rod.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that there is no specific allegation against the petitioner rather it is general and omnibus, on perusal of the injury report it is found that there is only one lacerated
Patna High Court CR. MISC. No.58354 of 2024(3) dt.18-10-2024 2/2 wound on frontal region of the head and there is no sign of repeated blow found on the body of the injured. It is also submitted that petitioner is in judicial custody since 07.04.2024. Similarly situated co-accused person, namely, Ballu Yadav @ Baliram Yadav has already been granted bail by this Court passed in Cr. Misc. No. 38275 of 2024 vide order dated 01.08.2024.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate II, Kaimur at Bhabhua in connection with Chainpur P.S Case No. 306 of 2023.
