2. The petitioner seeks bail in connection with Sessions Trial No. 452 of 2021 arising out of Mujahidpur (Babarganj) P.S. Case No. 177 of 2020, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.
3. The prosecution case, in brief, is that all the accused persons including this petitioner killed father-in-law of informant by pressing his neck.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submissions is that charge has already been framed on 04.10.2021. Till date, only one witness has been
Patna High Court CR. MISC. No.49253 of 2024(3) dt.18-10-2024 2/2 examined by the prosecution. Petitioner is in custody since 19.03.2021.
5. Learned A.P.P. appearing on behalf of the State opposed the prayer for bail.

Having considered the period of custody and tardy progress of trial, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VIII, Bhagalpur or Successor Court in connection with Sessions Trial No. 452 of 2021 arising out of Mujahidpur (Babarganj) P.S.
