Learned counsel for the petitioner undertakes to remove the defects within three weeks of normal functioning of the court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in a case registered for the offence punishable under Sections 307, 201, 34 of the Indian Penal Code.
Accusation against the petitioner is that he gave iron blow on the head of the informant resultantly informant became unconscious. The reason of the said occurrence is that petitioner
Patna High Court CR. MISC. No.39986 of 2020(2) dt.20-02-2021 2/2 Nandlal Bin had taken loan of Rs. 1,00,000/- from the informant to invest in his business and when the informant demanded his money, the said occurrence has been committed by the petitioner.
Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case due to demand his money. He submits that both parties are members of the same family and dispute for land and house is going on between them. He submits that none had seen this petitioner-accused assaulting the informant. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 15.06.2020.
In the facts and circumstances of the case, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Govindganj P.S. Case No. 254 of 2018.
