JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-06-2018 The petitioner seeks bail in anticipation of his arrest in connection with Desri P.S. Case No. 278 of 2013, dated 19.11.2013, instituted for the offences punishable under Section 392 of the Indian Penal Code.

The informant was waylaid by three miscreants and was divested of Rs. 20,400/- which was carrying on his person. The informant could identify the number of the motorcycle which was used by the miscreants, viz. BR-31K4342. During the course of the investigation, it came to light that the aforesaid vehicle was registered in the name of the petitioner. Only on the aforesaid information, the petitioner

Patna High Court Cr.Misc. No.21669 of 2018 (3) dt.28-06-2018 2/2 is sought to be prosecuted in the present case. Learned counsel for the petitioner has submitted that no doubt the vehicle was owned by him, but later, it was sold to one Uday Narain Rai on 16.01.2014. In support of the aforesaid contention, a copy of the sale letter has been brought on record by way of Annexure-2. It has further been submitted that the petitioner is a student and does not bear any criminal antecedent.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate-II, Vaishali at Hajipur in connection with Desari P.S. Case No. 278 of 2013.
