JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The accusation against the petitioner is that he brought acid in a plastic bottle and threw it on the informant causing injury to him.

Learned counsel for the petitioner drew my attention towards Annexure-2 series of the petition and submits that simple injury has been found on the person of the informant. It is further contended that excoriation of skin is possible only by hot oiled water because if the injury is caused by the acid there must be excoriation of the muscle.

Considering the aforesaid facts and circumstances as well as this aspect of the matter that the petitioner is in jail

Patna High Court Cr.Misc. No.20605 of 2015 (3) dt.08-10-2015 2/2 custody since 9.1.2015, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Baikunthpur P.S. Case No. 79/2014 to the satisfaction of the Chief Judicial Magistrate, Gopalganj.
