JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-03-2017 The petitioner is apprehending his arrest in connection with Bairia P.S. Case No. 12/2014, registered for offences punishable under Sections 420/431 Indian Penal Code and Section 40 of Bihar Minor Mineral Concession Rule, 1972. It has been submitted on behalf of the petitioner that petitioner only happens to be the owner of the tractors, which were seized, however it is submitted that the said tractor was given to the driver at that time and the petitioner was not at all aware of the said illegal act of the driver.
Heard learned A.P.P. and learned counsel appearing on behalf of Mines Department.

No.8772 of 2017 (4) dt.22-03-2017 2/2 Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the petitioner, the privilege of anticipatory bail, it is accordingly rejected. Let petitioner surrender before the court below and pray for regular bail and if any such application is filed, the court below after verifying the above submission of learned counsel for the petitioner, shall pass an appropriate order, without being prejudiced by the order of this Court.
