JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner apprehends his arrest in connection with Ara Nawada P.S. Case No. 645 of 2016, registered for the offences punishable under Sections 420, 341, 323, 504/34 of the Indian Penal Code.
Allegedly, the petitioner impersonating Umashankar Yadav executed sale deed in favour of Kusum Devi the wife of petitioner vide Deed No. 82082 whereon Santosh Kumar Dubey and Ramashankar Sah have put their signatures as witnesses. Submission is of false implication and that the the petitioner is ready to cancel the said sale deed by executing deed of cancellation and, as such, the petitioner should be granted
Patna High Court Cr.Misc. No.13568 of 2017 (3) dt.25-04-2017 2/2 provisional bail and after execution of cancellation deed the bail granted to the petitioner should be confirmed. The learned A.P.P. has got no objection.
In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within 08 (eight) weeks from the date of receipt/production of a copy of this order shall be released on provisional bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara, in connection with Ara Nawada P.S. Case No. 645 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C, and in the meantime, the petitioner shall execute the deed of cancellation in favour of his wife and after production of the deed of cancellation, the provisional bail granted, shall be confirmed by the learned court below itself and accordingly this Criminal Miscellaneous is hereby disposed of.
