This application is for grant of regular bail in connection with Masaudhi P.S.Case No.654 of 2018 for the offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

While the informant was sleeping with her husband, heard sound of firing and saw the petitioner and other accused persons fleeing away from the house. It further appears that the petitioner is accused in three other cases all under Section 302 of the IPC and other Sections of the IPC. Submission of the learned counsel for the petitioner is that there is no eye witness of the occurrence. He has been falsely made accused in this case. He is in custody for 11 months.

Patna High Court CR. MISC. No.43047 of 2019(6) dt.03-02-2020 2/2 Heard learned A.P.P. , who has opposed the pryaer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner .

With the aforesaid observation, this application is dismissed.
