Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in connection with POCSO Case No. 80 of 2019 arising out of Mojahidpur (Babarganj) P.S. Case No. 107 of 2019 registered under Sections 307, 457, 326A and 341 of the Indian Penal Code, 25(1-b)A, 26 and 35 of the Arms Act and 12 of the Protection of Children from Sexual Offences Act, 2012, pending in the Court of the Additional District & Sessions Judge VI-cum-Special Judge, POCSO Act, Bhagalpur.

Submission is that the prayer of bail of the petitioner

Patna High Court CR. MISC. No.4583 of 2021(2) dt.17-02-2021 2/2 has already been refused on merit on 24.02.2020 vide Cr. Misc. No. 68072 of 2019 while the petitioner is in custody since 22.04.2019, but, there is no progress in the trial. Admittedly, the prayer of bail of the petitioner has already been refused, on merit, taking into consideration the gravity of the offence of allegation, I am inclined to grant bail to the petitioner.
