The petitioner apprehends her arrest in Sigori P.S. Case No. 68 of 2016 instituted for the offence under Section(s) 409 of the Indian Penal Code.
It is alleged that this petitioner being Chairman of the PACS purchased total 2947 quintals of paddy for the financial year 2015-16 and after milling, the processed rice was to be deposited in the Bihar State Food & Civil Supplies Corporation till 30.07.2016 but only 808 quintals of processed rice was deposited and remaining 2139 quintals of processed rice was not made available.

No.14123 of 2017 (3) dt.04-04-2017 2/3 It has been submitted on behalf of the petitioner that the aforesaid paddy was delivered to the miller for preparation of the processed rice and the miller is absconding. As per written report, total 2947 quintals of paddy for the financial year 2015-16 was purchased but only 808 quintals of processed rice was deposited and remaining 2139 quintals of processed rice was not made available to the Bihar State Food & Civil Supplies Corporation. Hence, it is alleged that petitioner being Chairman of the PACS has misappropriated the remaining processed rice.
It has been submitted on behalf of the petitioner that petitioner is ready to deposit the amount of paddy alleged to have been misappropriated.
In the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on anticipatory bail. The prayer of the petitioner for anticipatory bail is rejected. However, keeping in view the submission of the petitioner to deposit the amount of paddy alleged to have been misappropriated, the petitioner is directed to surrender before the Court below within a period of six weeks from today in connection with Sigori P.S. Case No. 68 of 2016, pending in the Court of Judicial Magistrate, Danapur and seek regular bail, which
Patna High Court Cr.Misc. No.14123 of 2017 (3) dt.04-04-2017 3/3 shall be considered and disposed off on its own merit without being prejudiced by the order of this Court.
