The petitioners are apprehending their arrest in connection with Janki Nagar Police Station Case No. 149 of 2015, registered under Sections 406, 409, 420, 467, 468, 471 and 120B of the Indian Penal Code.
The present case has been lodged with respect to defalcation in Indira Awas Yojna scheme. The petitioners are not named in the F.I.R.
It has been submitted on behalf of the petitioners that in the case during the course of investigation it has come that the petitioners were the beneficiary of Indira Awas Yojna and except that there is nothing against them and further other accused persons having similar allegation have been granted anticipatory bail by this Court as also other Benches of this Court in Cr. Misc. No. 4887 of 2017, Cr. Misc. No. 6904 of 2017 and Cr. Misc. No.
Patna High Court Cr.Misc. No.15828 of 2017 (3) dt.12-04-2017 2/2 6910 of 2017, vide orders dated 15.02.2017, 14.02.2017 and 13.02.2017, respectively.
Heard learned Additional P.P. also.
Having heard both sides and in view of the fact that other accused persons having similar allegations have been granted anticipatory bail, let the petitioners, above named, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bonds of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Purnea in connection with Janki Nagar P.S. Case No. 149 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that the petitioner shall co-operate in the investigation and make themselves available before the police as and when required and in the event of failure on their part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of his bail bonds and further petitioners will not induce any witness or tamper with the evidence.
