There is specific allegation of rape against the petitioner in written report of the informant but when her statement was recorded under section 164 of the Cr.P.C, she retracted from her previous statement and stated that the petitioner was falsely implicated at the behest of the concerned police official and furthermore, she stated that the petitioner did no wrong with her.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge I, Supaul in POSCO case no. 20/2015 arising out of Birpur P.S. Case no. 155/2015.
