2. The petitioners apprehend arrest in connection with Madhuban P.S. Case No. 79 of 2025 dated 12.03.2025, instituted for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 333, 109, 76, 303(2), 351(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that on 11.03.2025 at about 08:30 pm, when the informant along with her family were going on bed after dinner then all accused persons including the petitioners armed with weapons came from back

Patna High Court CR. MISC. No.43522 of 2025(2) dt.16-07-2025 2/3 side of informant' house. Co-accused, Aniket Singh broke Almirah with iron rod. When the husband of the informant opposed illegal gathering and try to catch Aniket Singh then coaccused, Rana Ranjay assaulted with pistol on the head of informant's husband due to which he sustained head injury. It is further alleged that co-accused, Manoj Kumar @ Bharti tore the cloths of the informant.

4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is further submitted that there is no specific allegation against the petitioners rather the specific allegation is against co-accused Rana Ranjay, who assaulted with pistol on the head of the informant's husband due to which he sustained head injury. The allegation levelled against the petitioners is general and omnibus in nature. Lastly, it has been submitted that the petitioners have no criminal antecedents.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Madhuban P.S. Case

Patna High Court CR. MISC. No.43522 of 2025(2) dt.16-07-2025 3/3 No. 79 of 2025, they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, East Champaran at Motihari, subject to condition as laid down under Section 482(2) of the B.N.S.S.
