JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-02-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Jakkanpur P.S. Case No.227 of 2015 registered under Sections 420, 409 and 120B read with 34 of the Indian Penal Code.

It has been contended that the informant himself is the authorized signatory of the cheque and while the amounts were withdrawn, the authorities of the bank did not dispute the signature of the informant over the cheque. It has been further contended that though there may be dereliction of duty on the part of the petitioner, the petitioner was not actively associated in any manner with the alleged fraud. He is in custody since 12.7.2015 and has got roots in the society. It is also contended that since the

Patna High Court Cr.Misc. No.52933 of 2015 (3) dt.05-02-2016 2/2 investigation is over and charge-sheet has been submitted against the petitioner, he is not likely to tamper with the evidence. Learned counsel for the State has opposed the application for grant of bail to the petitioner. Regard being had to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Sangeeta Rani, Judicial Magistrate, 1st Class, Patna in connection with Jakkanpur P.S. Case No.227 of 2015.
