JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2017 The petitioner is apprehending his arrest in connection with Sultanganj P.S. Case No. 247 of 2015, registered for offences punishable under Sections 341, 323, 385, 307, 504, 506 and 34 Indian Penal Code and Section 27 of Arms Act. It has been submitted on behalf of the petitioner that in this case only vague allegation of demand of rangdari has been made against the petitioner and there is nothing on record to suggest that petitioner assaulted the informant, as such, no case under Section 307 and other Sections of Indian Penal Code is made out against the petitioner. It has further been submitted that petitioner has clean antecedent and other co-accused of this case has already been granted bail by this Court vide order dated

Patna High Court Cr.Misc. No.16346 of 2017 (2) dt.08-04-2017 2/2 16.12.2016, passed in Criminal Miscellaneous No. 45307 of 2016. Learned counsel for the State also could not controvert the aforesaid submissions of learned counsel for the petitioner. Having heard both sides, in view of the fact that no specific allegation has been levelled against this petitioner and other co-accused has already been granted bail by this Court, as such, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bhagalpur in connection with Sultanganj Case No. 247 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
