18-12-2015 Heard Sri Ranjeet Kumar Pandey, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody only since 07-07-2015 in Thawe P.S. Case No. 71 of 2015 registered for the offence under Sections 302/34 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that during post-mortem examination, the injury, which was alleged in the F.I.R., was not corroborated and he has further argued that there was case and counter case.
Be that as it may, in the F.I.R. itself, there is specific accusation against the petitioner and moreover, the petitioner is in custody only since 07-07-2015 and as such, at the moment, I am
Patna High Court Cr.Misc. No.55343 of 2015 (2) dt.18-12-2015 2/2 not inclined to grant bail.
The petition stands dismissed.
