The petitioners apprehend their arrest in Belaganj P.S. Case No. 355 of 2016 instituted for the offence under Section (s) 147, 148, 149, 341, 323, 324, 307 of the Indian Penal Code.
From the written report, it appears that in the background of land dispute, the occurrence has taken place. There is allegation that these petitioners assaulted the members of the prosecution party causing injuries.
The injury reports of the injured have been annexed as Annexure-2 series. It appears from the injury reports
Patna High Court Cr.Misc. No.13896 of 2017 (2) dt.24-03-2017 2/2 that none of the injured sustained any injury on the vital part of the body. All the injuries of the injured have been found to be simple in nature except one injury of injured Mahfuj Alam which was found to be grievous as fracture on left thumb. It has been mentioned in para 3 of the petition that petitioners have no criminal antecedent. In the facts and circumstances of the case, the prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, above named, within six weeks from today in connection with Belaganj P.S. Case No. 355 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, XI, Gaya, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
