The petitioner seeks bail in a case under Sections 302, 324, 323, 307/34 of the Indian Penal Code.
Learned counsel for the petitioner submitted that the petitioner is in custody for more than six years, but the trial has not yet been concluded.
From perusal of the report at Flags 'B' and 'C' of learned Addl. District & Sessions Judge, Patna, it appears that earlier prosecution had filed a petition for recalling of prosecution witness but no order was passed nor the prosecution produced any witness. Now the prosecution evidence is closed and, the case is fixed for recording statement under Section 313 of Cr.P.C.

No.56117 of 2015 (5) dt.04-05-2016 2/2 Considering the fact that trial is at the fag end, the prayer for enlarging the petitioner on bail in Sessions Trial No. 1188/10, arising out of Bikram P.S. Case No. 207/09, is rejected. The trial court is directed to immediately record the statement of accused persons and after giving sufficient opportunity to the defence dispose of the trial as soon as possible.
