The petitioner seeks quashing of the order dated 26.04.2019 passed by the learned 1st Additional Sessions Judge, Rosera, Samastipur in Sessions Trial No. 150(S) of 2001, arising out of Rosera P.S. Case No. 213 of 1996 registered for the offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act, by which the prayer made on behalf of the petitioner for his discharge has been rejected. It appears that the petitioner was summoned to

Patna High Court CR. MISC. No.44544 of 2019(2) dt.02-09-2019 2/2 face trial along with other accused persons on 18.12.2012 but the order for discharge has been passed after about seven years.

This Court would not like to go into the merits of the case for the reason that petitioner has approached the Court below after an unusually long delay which cannot be explained under any circumstance.

The petition is dismissed.
