Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Nokha P.S. Case No. 286 of 2018, registered under Sections 406 and 420 of the Indian Penal Code. The accusation is that in spite of giving notice to Rajiv Kumar Singh, Ram Chandra Singh (petitioner) and Sachitanand Sinha, respectively, Chairman of Hathni, Dakchini Barav and Chhatauna PPCS, they did not take any heed for

Patna High Court CR. MISC. No.39967 of 2020(2) dt.20-07-2021 2/2 audit, which is due since 2015.

Learned counsel for the petitioner submits that only allegation has been made against the petitioner that he being the Chairman of Dakhsini Barav PACS did not take any heed for audit of PACS. Further submission is that late on, audit was made on 09.09.2019 by Senior Audit Officer, Cooperative Society, Sasaram, Rohtas, which would appear from Annexure 2 and no any defect was found in the record.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rohtas, in connection with Nokha P.S. Case No. 286 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
