The present petition has been preferred for quashing the Charge Sheet No.597 of 2015 dated 29.08.2015 in Sitamarhi P.S. Case No.277 of 2015 pending in the court of learned Chief Judicial Magistrate, Sitamarhi.

As per the prosecution story, two boys and a girl approached his brother to drop in the examination and accordingly he took them in his vehicle. As he failed to return and neither the brother nor the vehicle could be located, GRP DBG (SMI) P.S. Case No.09 of 2015 was lodged on 21.02.2015. During investigation, the police apprehended three persons who disclosed that the gang leader is Ajay Jha @ Babua Don and upon contact through mobile he demanded

Patna High Court CR. MISC. No.57680 of 2015(2) dt.24-03-2023 2/2 Rs.3,00,000/- in lieu of the vehicle. As the informant did not wanted to make payment complaint made and accordingly Sitamarhi P.S. Case No.277 of 2015 was lodged under Section 387 of the Indian Penal Code.

Considering the kind of allegation that has come in the FIR no case of interference is made out.

Accordingly, the petition stands dismissed.
