JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Imadpur P.S. Case No. 59 of 2016, registered for the offences punishable under Sections 143, 341, 188, 353, 504, 506 of the Indian Penal Code.

Allegedly, the petitioner and 50 unknown villagers blocked the road and were making slogan against the administration.

Submission is of false implication and that at that time the Mukhiya Adam Mansoori along with his family members came near the newly built house of Kasi Nath Keshari and damaged the wall of the said house and also made open firing to

Patna High Court Cr.Misc. No.10974 of 2017 (2) dt.20-03-2017 2/2 which one Khurshid Alam called police and also Imadpur P.S. Case No. 58 of 2016 was lodged against Adam Mansoori. The road was blocked for few minute in protest as the police did not come in time and not to take any action against the said Mukhia. The petitioner is a man of means and there is no chance of tampering with prosecution evidence.

The learned A.P.P. opposes the prayer of pre-arrest bail by submitting that the act of the petitioner is against the administration as well as the society.

In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Siddhartha Pandey, learned Judicial Magistrate, Bhojpur at Ara, in connection with Imadpur P.S. Case No. 59 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
