Petitioners seek bail in Begusarai (Muffasil) P.S. Case No.232 of 2019 instituted for the offence under Section(s) 302 and other allied sections of Indian Penal Code. Counsel for the petitioners submits that petitioners are named in the First Information Report but there is no allegation of any specific overt act against the petitioners. In the written report, it is alleged that on the date of occurrence, informant along with Aman Kumar was going on motorcycle. Near Bharra Chowk, two boys were causing obstruction in traffic. The informant requested to give way upon

Patna High Court CR. MISC. No.43574 of 2019(2) dt.19-07-2019 2/2 which one Randhir Kumar assaulted the informant with fists and slaps. In the meantime, Aman Kumar (since deceased), who was sitting on the motorcycle, made firing in the air. Thereafter, Randhir Kumar, his father Vijay Paswan and other family members and 15-20 unknown persons assaulted them by rod and bricks etc. on account of which Aman Kumar died. Petitioners are in custody since 10.05.2019 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Begusarai (Muffasil) P.S.
