JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-06-2021 Heard Mr. Akshay Lal Pandit, learned advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Mairwa P.S. Case No. 79 of 2019, instituted for the offences under Sections 307, 34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner has not been named in the First Information Report. Even in the further statement of the informant, the petitioner has not been named. His prosecution in the instant case is only on the basis of confession of an arrested accused person.

No.40647 of 2020(2) dt.16-06-2021 2/2 Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the Court below within a period of eight weeks from the date of receipt/ production of a copy of this order, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VII, Siwan in connection with Mairwa P.S. Case No. 79 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. While saying so this court has also taken note of the fact that the petitioner does not have criminal antecedents.
The petition stands disposed of.
