1. Heard learned senior counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379 and 34 of the Indian Penal Code.
3. The learned senior counsel for the petitioner submits that the petitioner has antecedent of four cases, but then, out of four cases, three cases were instituted on account of dispute in the village in between two communities in which large number of people were implicated and the 4th case was instituted by the instant informant, who is own uncle of the petitioner. It is next submitted that the informant, who is own uncle of the petitioner alleges that on 22.02.2024 at 10.00P.M.

No.48662 of 2024(2) dt.25-07-2024 2/3 while he was returning from an Ashtayam and was going towards his home, when on account of earlier land dispute, his agnates Chhotan Dixit and Safal Dixit @ Ravi Ranjan Dixit @ Safal Dikashit (petitioner) surrounded him and started assaulting and thereafter, the petitioner started pressing the thread of the locket around his neck and assaulted him by kicks and punches on his stomach and chest and thereafter, Chhotan tried to strangulating him and also assaulted on his private part. Thereafter, he was taken to Narkatiaganj Hospital from where he was referred to Bettiah for better treatment.

The learned senior counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that on account of land dispute, the occurrence is alleged to have taken place. It is also submitted that informant, being uncle, is trying to usurp the property of the petitioner. It is next submitted that in order to coerce the petitioner into submission the instant false case has been instituted. It is next submitted that earlier also the informant had instituted a criminal case against the petitioner, who is a practicing advocate.
5. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran in connection with Shikarpur P. S. Case No.156 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
