2. The present writ petition has been filed for directing the respondents to pay the petitioner the pay scale recommended by the 6th and 7th pay commission which is being given to the other identical employees further to refix the pay and his entire retirement benefits and to pay the pension of the petitioner as per the new fixation rule

3. Learned senior counsel for the petitioner submits that petitioner has filed his representation which is annexed as Annexure-P/2 on which no decision has been taken till date.

4. Counsel for Patna Municipal Corporation submits that the Chief Executive Officer and Municipal Commissioner i.e. Respondent No. 3 is the same persons.

5. In the light of the submission the present writ petition is disposed off directing the petitioner to file a fresh representation alternatively within 30 days and Respondent No. 3 is directed to consider the representation of the petitioner and pass reasoned and speaking order within 90 days thereafter, from the date of production of the present order.
