This application has been filed on behalf of the petitioner for modification in the order dated 08.03.2017 passed in Criminal Misc. No.2424 of 2017 with regard to the father's name of the petitioner no.2 (petitioner herein).

It appears that vide order dated 08.03.2017 passed in Criminal Misc. No.2424 of 2017 by this Court, while the application in respect of the petitioner nos.1 and 3, namely, Beni Singh and Rai Ji Singh alias Rai Ji respectively was dismissed as withdrawn but the petitioner no.2 Rajo Singh (petitioner herein), petitioner no.4 Narendra Singh and petitioner no.5 Deep Narayan Singh, in the event of their arrest or surrender by them within six

Patna High Court Cr.Misc. No.21106 of 2017 (2) dt.17-05-2017 2/3 weeks from that day, were directed to be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Chautham P.S. Case No.100 of 2016/G.R. No.1680 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. Learned counsel appearing on behalf of the petitioner submits that due to wrong mentioning of the father' name of the petitioner no.2 Rajo Singh (petitioner herein) in the cause title of Criminal Misc. No.2424 of 2017 as Late Shiwan Singh, the father's name of the petitioner no.2 Rajo Singh (petitioner herein) has been typed in the cause title of the aforesaid order dated 08.03.

2017 passed in Criminal Misc. No.2424 of 2017 as Late Shiwan Singh but, in fact, the father's name of the petitioner no.2 Rajo Singh (petitioner herein) is Late Bhikhan Singh and prays for modification in the cause title of the aforesaid order dated 08.03.2017 passed in Criminal Misc. No.2424 of 2017 with regard to the father's name of the petitioner no.2 Rajo Singh (petitioner herein).

In that view of the matter, in the cause title of the aforesaid order dated 08.03.2017 passed in Criminal Misc. No.2424 of 2017 by this Court, the father's name of the petitioner

Patna High Court Cr.Misc. No.21106 of 2017 (2) dt.17-05-2017 3/3 no.2 Rajo Singh (petitioner herein) be read as "Late Bhikhan Singh" in place of "Late Shiwan Singh".

The order dated 08.03.2017 passed in Criminal Misc. No.2424 of 2017 by this Court is modified to the aforesaid extent only.

The period of surrender of the petitioner no.2 Rajo Singh (petitioner herein) in the trial court in connection with the aforesaid case is further extended for four weeks from today. This application is, accordingly, disposed of. (Rajendra Kumar Mishra, J) P.S./- U T
