2.The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Sirdala P.S. Case No. 147 of 2025 instituted for the offence under Sections 191(2), 191(3), 190, 195(1), 126(2), 115(2), 117(2), 118(1), 118(2), 109, 132, 121(2), 324(4), 352, 351(2) of the B.N.S., 2023.
3. The case of the prosecution is that one of the police personnel was surrounded by the villagers and he was being assaulted. In the FIR, Chowkidar has disclosed the name of 13
Patna High Court CR. MISC. No.46689 of 2025(2) dt.01-08-2025 2/3 known persons and 10-15 unknown persons. The names of these petitioners have been disclosed by the Chowkidar.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in this case. He also submits that the nature of allegation is general and omnibus. There is no specific allegation against these petitioners. It is further submitted that similarly situated other co-accused person has already been granted bail by Co-ordinate Bench of this Court vide order dated 09.07.2025 in Cr. Misc. No. 41254 of 2025.
5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioners and submits that petitioner no.1 has criminal antecedent of two cases whereas petitioner no. 2 has criminal antecedent of one case.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Sirdalla P.S. Case No. 147 of 2024, they will be enlarged on bail on furnishing bail bond of
Patna High Court CR. MISC. No.46689 of 2025(2) dt.01-08-2025 3/3 Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV at Nawada, subject to the conditions as laid down under section 482(2) of the B.N.S.S.
