This is a petition for grant of anticipatory bail for offence under Section 498A of the Indian Penal Code. The anticipatory bail application of the husband of the informant is pending before a coordinate Bench of this Court. The petitioner is mother-in-law. There is general and omni bus allegation of demand of dowry and torture for the same against the petitioner also. Submission of the petitioner is that the petitioner has purchased property which informant wanted to sell away and for that the present false case has been instituted.

The learned counsel for the informant opposed the prayer that the petitioner is main instrument in whole

Considering the facts and circumstances specially the fact that the petitioner is a female, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Khagaria (Mahila) P.S. Case No. 5 of 2017 to the satisfaction of the Subdivisional Judicial Magistrate, Khagaria, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
