The petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. Prosecution case in brief is that one Amarjeet Kumar, lodged this instant case, alleging therein that on 30.11.2019 while he was coming with his mother from the Bank after withdrawing Rs. One lac for the purpose of marriage expenditure, then in the mid way, the unknown criminals have taken out the aforesaid cash from the dickey of his motorcycle and fled away.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that the petitioner is not named in the

Patna High Court CR. MISC. No.39798 of 2020(3) dt.10-03-2021 2/2 FIR and he has been made accused on the basis of confessional statement of co-accused. There is no any T.I. Parade till date. The petitioner is languishing in judicial custody since 09.09.2020. The petitioner has got 09 criminal antecedents which is mentioned in para 3 of the bail petition. Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail after framing of the charge on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Naubatpur P.S. Case No. 757/2019 to the satisfaction of learned Court below where the case is pending.
