2. The present application has been filed seeking modification of the order dated 17.02.2024 passed in Cr. Misc. No. 7556 of 2024, whereby the petitioner was granted regular bail.

3. Learned counsel for the petitioner submits that while filing the bail application, certain old criminal antecedents pertaining to the years 2003 to 2006 could not be disclosed due to inadvertence and lack of complete records. It is submitted that there was no intention to suppress any material fact and the petitioner seeks permission to bring the omitted antecedents on record.

Having considered the submissions of the parties and the materials available on record, this Court is of the view that the modification sought is not clerical or formal in nature but goes to the merits of the earlier order. Such a modification would require reconsideration of the merits of the order, which cannot be undertaken in an application for modification.

5. Accordingly, the present application is dismissed as not maintainable, with liberty to the petitioner to avail such remedy as may be available in law by filing an appropriate application disclosing the complete criminal antecedents. (Sandeep Kumar, J) Shishir/- U T
