The petitioner seeks bail in a case registered under Sections 376, 420 of the Indian Penal Code.
Allegedly, on the false pretext of marriage, the petitioner established physical relationship with the informant and later on, refused to marry her.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 23-05-2019. Charge sheet has already been submitted. On the false pretext of marriage, the petitioner established physical relationship with the
Patna High Court CR. MISC. No.41815 of 2019(2) dt.11-07-2019 2/2 victim/informant. Counsel for the petitioner has relied upon the decision reported in (2013)9 SCC 293 (Prashant Bharti v. State (NCT of Delhi), and (2019) SCC ONLINE 3100 (Dr. Dhruvaram Murlidhar Sonar Vs. The State of Maharashtra & Ors.).
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Taking into account the reliance placed by learned counsel, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Priya Shankar, learned Judicial Magistrate-Ist Class, Patna in connection with Mahila P.S. Case No. 47 of 2019. (Sudhir Singh, J) A.K.V.//- U T
