Petitioner seeks regular bail in connection with Rajpur PS Case No. 122/2021 registered for the offence punishable under Section 304(B)/34 of the IPC and Section 3⁄4 of the Dowry Prohibition Act.

As per prosecution story, the informant being father of the deceased has alleged that on 21.06.2021, he received information that the petitioner along with other accused persons have killed the daughter of the informant due to non fulfillment of the dowry demand.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged

The entire family members have been made accused on the basis of general and omnibus allegation and the informant has also not disclosed that just before the occurrence, the petitioner had tortured the deceased for want of dowry. Learned counsel next submits that the petitioner is in custody since 23.06.2021 and the chargesheet has already been submitted in the matter. Regards being had to the submissions made by the parties and taking into consideration the nature of allegation and the fact that allegation against the petitioner is general and omnibus in nature, petitioner is in custody since 23.06.2021 and the charge-sheet has already been submitted in the matter, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, JANKI DEVI, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Buxar in connection with Rajpur PS Case No. 122/2021.
