JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-12-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code and u/s 25(1-b)A, 26, 35 of Arms Act.

As per the prosecution case, one loaded country made pistol has been recovered from the possession of this petitioner. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. Petitioner is in custody since 01.09.2020 and he has already remained in custody for more than one year and investigation in this case is complete.
