JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-04-2018 Learned counsel for the petitioner seeks permission to withdraw the writ petition in order to approach the State Appellate Authority which is now functional.

Since the writ petition was filed at the time when the State Appellate Tribunal was not functional and this writ petition remained pending for more than two years before this Court, liberty is granted to the petitioner to file an appeal within a period of one month along with a copy of this order and in case such appeal is filed, the State Appellate Tribunal is required to decide the appeal on its own merit after condoning the delay.
