2. The petitioner is in custody since 12.05.2023 in connection with Complaint Case No. 1321C of 2020 registered for the offence punishable under Sections 341/323/307/406/ 498(A)/354(B)/379 of the Indian Penal Code and Section 3/4 of the Muslim Women Protection of Rights on Divorce Act.
3. As per the prosecution case, the petitioner is accused of torturing his wife.
4. Learned counsel for the petitioner submits that the complainant has left her matrimonial home voluntarily without
Patna High Court CR. MISC. No.46651 of 2023(2) dt.28-07-2023 2/2 any reasonable cause and filed this false complaint case with an ulterior motive. He further submits that the petitioner is ready to restore his conjugal relationship with the complainant with full honour and dignity.
5. However, learned A.P.P. appearing on behalf of the State vehemently opposed the bail application.
6. In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st Class, Begusarai, in connection with Complaint Case No. 1321C of 2020.
