2 The petitioner has invoked the jurisdiction of this Court seeking a direction upon the respondent no. 4 to extend the benefit of 1st ACP with effect from 09.08.1999 in the scale of Rs. 4000-6000 and 2nd ACP with effect from 01.01.2009 in the pay scale of Rs. 5200-20200 with grade pay of Rs. 4500/- and further 3rd MACP with effect from 05.10.2015 in the pay scale of Rs. 9300-34800 with grade pay of Rs. 5000/-. The petitioner is also aggrieved with the inaction of the respondent in not
Patna High Court CWJC No.10505 of 2025(2) dt.10-07-2025 2/3 extending the payment of arrears/dues of Rs. 1,30,645/- for the period 01.07.2012 to February, 2017 in the light of Letter No. 265 dated 14.06.2023.

Mr. Girish Pandey, learned Advocate for the petitioner referring to Annexure 4 to the writ petition has contended that despite the recommendation made in favour of the petitioner, till date, the petitioner has not been extended the benefit of ACP; hence the present writ petition. For redressal of the grievance regarding benefit of ACP, a representation has been filed before the District Magistrate, Aurangabad, the copy of which has already been placed on record as Annexure P/6. So far the grievance with regard to the payment of dues/ arrears of Rs. 1,30,645/- is concerned, for which the petitioner requested by filing a representation to the C.D.P.O., Daudnagar and the District Programme Officer, but to no effect.
4. The learned Advocate for the State submits that since the representation is pending before the concerned authorities, they would consider the same and disposed off in accordance with law.
5. Considering the aforesaid submissions, the present writ petition stands disposed off with a direction to the District Magistrate and the C.D.P.O., Daudnagar, Aurangabad to
Patna High Court CWJC No.10505 of 2025(2) dt.10-07-2025 3/3 consider the representation of the petitioner, in accordance with law, as contained in Annexure P/6 and P/8, preferably within a period of 12 weeks from the date of receipt/production of a copy of this order.
6. Suffice it to observe that during the interregnum period, the consequential benefit shall also be accorded to the petitioner.
