This is the second attempt of the petitioner to seek bail as earlier vide order dated 16.02.2022 in Cr. Misc. No. 54574 of 2021, the regular bail of the petitioner was rejected by a well reasoned order.
In the present petition which has been filed seeking bail, no pleading has been made with respect to the stage of the case, learned counsel for the petitioner thus submits that a report be called for from the learned trial court with regard to the steps having been taken in this case after the order dated 16.02.2022. The Court does not feel persuaded by the submission of the learned counsel for the petitioner nor any new grounds have been pleaded in the present bail application for seeking
Patna High Court CR. MISC. No.45386 of 2022(2) dt.31-08-2022 2/2 bail.
At this stage, learned counsel for the petitioner submits that at paragraph '11' he has pleaded that there is no sufficient progress in the case to which the learned A.P.P. for the State rebuts the submission made by the learned counsel for the petitioner and submits that a vague and cryptic statement has been made in the bail application as it cannot be presumed that the person who had come to instruct the learned counsel for filing the second bail application was not aware what was happening in the case.
