Counsel for the State submits that during the pendency of the writ application the entire post-retiral dues have been paid to the petitioner.

Counsel for the State, referring to the supplementary counter affidavit filed on behalf of respondent no.6 dated 9.10.2017 submits that all the post-retiral dues have been paid to the petitioner. He submits that in addition thereto, another supplementary affidavit has been filed on 7.10.2017, however, copy of the aforesaid supplementary affidavit has been shown to

Patna High Court CWJC No.3794 of 2016 (4) dt.11-10-2017 2/2 this court which was affidavited vide oath no. 4649 dated 22.09.2017 wherein stand has been taken in para-4 on wards that during pendency of the writ application, the entire admissible dues have been paid to the petitioner.

In view of the stand taken by the respondents in the supplementary counter affidavit filed on 7.10.2017, the writ application is disposed of with liberty to the petitioner that if he is still aggrieved by any error of calculation of pensionary dues or on account of non-payment of any of the post-retiral dues he shall be at liberty to raise grievance with regard to calculation etc. out of post-retiral dues within a period of one month from this order by way of filing representation and if such representation is filed, the respondent authorities would be under obligation to address the grievance raised by the petitioner by a reasoned and speaking if the petitioner is found entitled to any further post-retiral dues which has not been paid till date, the respondents shall ensure payment of the same within a period of two months from the date of such decision.

With the aforesaid observation, the application stands disposed of.
