It has been submitted that marriage of the petitioner was performed with Complainant on 22.9.2012. After marriage, petitioner started torturing the complainant for demand of dowry and ultimately ousted her from matrimonial home, on 16.10.2014. Petitioner has stated that he has divorced his wife and admitted that he has performed another marriage. The opposite party No. 2 (wife) has submitted that no divorce has taken place. Petitioner has committed physical and mental torture with her. He has performed another marriage in the

Patna High Court Cr.Misc. No.10023 of 2017 (3) dt.24-04-2017 2/2 year 2016 with Naznin Khatoon.

In support of divorce, one document has been filed as Annexure-2 which does not bear the signature of either of the parties. The petitioner is not ready to keep his wife. There is specific allegation against the petitioner of committing physical and mental torture with the complainant.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
