The petitioner apprehends his arrest in Sahebpur Kamal P.S. Case No. 115 of 2016 instituted for the offence under Section (s) 47(a) of the Bihar Excise (Amendment) Act.

It is alleged that 528 bottles each containing 375 ml and 176 bottles each containing 180 ml of foreign liquor was recovered from the Scorpio vehicle and motorcycle. The owners of the said vehicles succeeded to run away. The Chaukidar has disclosed the names of the persons who fled away which included the name of this petitioner.

It has been submitted that other co-accused

Patna High Court Cr.Misc. No.7920 of 2017 (2) dt.23-02-2017 2/2 whose names have been disclosed by the Chaukidar namely Manoj Kumar Sah and Gautam Yadav have been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 53183 of 2016 on 08.12.2016 and Cr. Misc. No. 949 of 2017 on 18.01.2017. In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Sahebpur Kamal P.S. Case No. 115 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Vth, Begusarai, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
