JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-05-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 147, 148, 149, 188, 353, 504 and 506 of the Indian Penal Code.

Petitioners are named in the FIR and allegation against them is of blocking the road and also creating obstruction to the public.

Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that there is no specific allegation against the petitioners and other similarly situated accused persons have been granted anticipatory bail vide order dated 28.04.2017 passed in Cr. Misc. no.19867 of 2017.

Having heard both sides and in view of the allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners.

However, petitioners may surrender in the court below at Banka in connection with Banka (Barahat) P. S. Case no. 33 of 2017 and make prayer for regular bail which will be considered and disposed of, if possible on the same day, on the fact that no specific allegation is there against the petitioners as well as other co-accused have been granted anticipatory bail by this Court without being prejudiced by the order of this Court.
