JUSTICE SANJAY PRIYA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Mansi P.S. Case No. 127 of 2016 instituted for the offence under sections 302, 120(B)/34 of the Indian Penal Code.
It is alleged that informant got information from the villagers in the morning that dead body of his father is lying on railway line. The informant found several injuries on his person. The informant further alleged that his father used to sale milk. There was dues amount with Manju Devi, wife of late Dilip Sahni. The informant has raised suspicion against this petitioner. He has further stated that co-accused alongwith this petitioner has committed murder of his father.
It is submitted on behalf of the petitioner that mother
Patna High Court Cr.Misc. No.10635 of 2017 (2) dt.10-03-2017 2/2 of co-accused has already been granted bail by a coordinate Bench of this court in Cr. Misc. No. 51583 of 2016 vide order dated 02.12.2016.
From the written report, it appears that mere suspicion has been raised against this petitioner. From the order of Sessions Judge also, it appears that there is no substantive material against this petitioner.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Mansi PS. Case No. 127 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, subject to the conditions as laid down under Section 438(2) Cr.P.C.
