The present writ petition has been filed for quashing the impugned order dated 05.07.2012 as contained in Annexure-2 passed by the respondent Sub-divisional Officer, Sadar, Saharsa whereby the petitioner's licence for selling kerosene oil on mobile Thela has been suspended on the pretext of institution of F.I.R. vide Mahisi P.S. Case No. 72/2012 under Section 7 of the Essential Commodities Act.

3. Learned counsel for the petitioner submits that the impugned order of suspension was valid only for a period of 90 days in terms of the provisions of the Bihar Trade Articles (Licenses
