Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307, 379 and some other allied Sections of the Indian Penal Code. As per the prosecution case, all the accused persons, including these petitioners, armed with sharp weapon, assaulted the husband of informant. It is further alleged that petitioners, armed with Gadasi and Fasuli assaulted at the neck of husband of informant and also outraged the modesty of the informant. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in
Patna High Court CR. MISC. No.55218 of 2021(3) dt.06-07-2022 2/2 the case. It is submitted that FIR has been lodged after eight days of the occurrence without any explanation. It is submitted that petitioner No.1 has filed Jamo Bazar PS case No. 47/2020 against the husband of informant and in order to put pressure to withdraw the FIR this false and concocted case has been filed. Injuries are reported to be simple in nature. Petitioners have got clean antecedent.
Learned counsel appearing for the State opposes the prayer for anticipatory bail.
Considering the facts of the case and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Siwan in connection with Jamo Bazar PS case No.177/2020, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
