JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-06-2021 Heard Mr. Sanjay Kumar Jha, the learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Sarai P. S. Case No.186 of 2020, instituted for the offences under Sections 413, 414/ 34 of the Indian Penal Code.
The Officer-in-Charge of the concerned Police Station learnt that a few miscreants have stolen a trailer of a tractor. Three persons were apprehended and they have disclosed that the petitioner was one of their companions.
Hence, the prosecution of the petitioner in this case. The learned counsel for the petitioner has submitted that except for the confession of the arrested accused persons, there is no other material to connect the petitioner with the
Patna High Court CR. MISC. No.40696 of 2020(2) dt.22-06-2021 2/2 offence. He further submits that he has been made accused at the instance of the Officer-in-Charge of the local police station to further harass him.
Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XVI, Vaishali at Hajipur in connection with Sarai P. S. Case No.186 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
