JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State assisted by the informant. The petitioner apprehends her arrest in connection with Runisaidpur P.S. Case No.319/16 registered under Sections 376, 342, 341, 323, 504 and 506/34 of the Indian Penal Code and Section 6/7 of the POCSO Act.
The accusation is that the informant used to do job as maid at the house of Ganaur Rai, who happens to be the husband of the petitioner, developed physical relationship with the informant giving allurement of money and ultimately she conceived pregnancy of four months and when she apprised him of this fact he gave threatening to kill her. She narrated the story
Patna High Court Cr.Misc. No.4558 of 2017 (2) dt.16-03-2017 2/2 of rape upon her to her parents, then they went to the house of Ganaur Rai to complain upon which, Ganaur Rai, his son Ramji Rai, wife Devkalia Devi assaulted and threatened for dire consequences.
Learned counsel for the petitioner submits that in fact, the petitioner has been falsely implicated in this case being the wife of co-accused, Ganaur Rai who is said to have committed rape at the informant.
Having regard to the facts and circumstances of the case, let the above named petitioner, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today,be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-1st, Sitamarhi, in connection with Runisaidpur P.S.
